A: Marreed-Prestman liaisons with principals contracted* or a Third Party "contact person" who is identified and authorized to make changes and/or order additional work on your behalf.

Marreed-Prestman works with either principals contracted or a designated Third Party but, not both on the same job. Any Third Party must be noted on the contract prior to signing on with Marreed-Prestman.

Principals are responsible for "Final Billing". X-Link (sister page): ("B") and ("E").

1. A Third Party may be identified as a Project Manager, Builder, Renovator, Restoration, Insurance or Finance Company, etc.

2. Contracts are not accepted by Marreed-Prestman where funds/payment and/or approvals are regulated or restricted through a Third Party.

3. Marreed-Prestman has developed proprietary "methodologies". As such, expertise and specialty processes are closely guarded and will not be 'shared' with Principals or Third Party Persons.

4. Contracts are subject to Job Suspension, or perhaps, Cancellation — at the sole discretion of Marreed-Prestman:

if the signatory/s to a Contract violates the T&C of the Contract.

bullet

if the signatory to a Contract transfers — voluntarily or involuntarily — responsibility for funds/payment to a Third Party after contracting with Marreed-Prestman.

if a legal "Statement of Claim" is registered against the subject property by a tradesperson or stakeholder (which may or may not inhibit job progress, safety and/or security).

bullet

if "Final Billing Upon Demand"  is not paid promptly (via cash or Certified Cheque) ... and prior to 'lost time' and job completion.

5. Job Suspension or Job Cancellation — at the sole discretion of Marreed-Prestman — will nullify my Lifetime Warranty and result in the loss of any Job/Price Variable, such as, Quantity-Discounted Pricing, Bonus Savings and Regional Incentives.

6a.Upon invoking either the Job Suspension or Job Cancellation Clause via Written Notice, Marreed-Prestman is entitled to "Payment-on-Demand" for the full amount of the Contract Price plus, "Options", "Essentials" and any "Legal/Collection Costs" incurred ...

5b "Job Suspension" or "Job Cancellation" may be reinstated — at the sole discretion of Marreed-Prestman — subject to an updated Contract and "updated" T&C, current market pricing and travel charges. In addition, a Job Reinstatement Fee (Minimum $ 800.00) and a Job-Split Fee (25% of order, minimum as follows (whichever is greater): $ 500.) may apply.

6. Principals are responsible for the full replacement cost of any and all Marreed-Prestman (digitally documented) job materials and/or equipment that is "removed" or "impounded" on, the subject property (by Principals, other stakeholder or Third Party).
7. Building/Renovation Permit, Insurance and "Job Site Security" is the sole responsibility of the Principals and/or their representative.

"Should you require "special consideration" or "extended payment terms" these options may be considered, upon request. If you are planning new construction under a "Builder's Loan" and require a more flexible payment schedule, your request may be accommodated based on "Pre-Approved Funding" and/or a Personal Guarantee."

    3a. Principal(s) who Delay Delivery beyond the agreed delivery date (or window) are subject to the delivery being rescheduled at the sole discretion of Marreed-Prestman — without compensation — so as not to inconvenience other Clients awaiting pre-scheduled delivery and/or installations and/or finishing.

4a) Marreed-Prestman offers Bargain Priced Travel and Lodging for Working Forman on Full Installations, as required.

6) Marreed-Prestman may accept your Labour Crew and provide a Labour Cost Rebate... you and/or two or three of your STRONG "Family or Friends" can act as "CREW" on your job (only). I hold myself fully responsibility for the high quality of your flooring project. "Crew" is usually required for about two or three days in total.

6b) Likewise, Clients who choose to provide reliable local and, but perhaps, unskilled construction labour (one, two or three strong men with basic but, reliable, tool-handling ability will work under my direct hands-on supervision (for about two or three days in total.), are responsible for the availability and performance of the crew they engage. In exchange, Marreed-Prestman will credit clients "who choose to hire locally" as per my usual local labour cost.

Furthermore, Clients accept that Marreed-Prestman regularly and easily installs 400 sf. to 500 sf. on "Start Day" and 600 sf. to 800 sf. on subsequent days. Therefore, client-supplied workers are expected to attain this basic standard of performance in order to control installation costs and meet our desired timeline.

As an Outlier-Oriented Company we are Distinct, Resourceful and Outside Normal Expectations ...  as follows.

7) CHOOSE ONE OF THREE FINAL FINISHING OPTIONS.

Marreed-Prestman defines Full Installation as including all Premium Materials, Expert GripTightTM Installation and my Proprietary Artistic Finishing but, not all Clients require my Expertise nor, my Proprietary Artistic Finishing ...
Therefore, Clients can take advantage of Marreed-Prestman's VALUE PACKAGE. The Value Package includes Premium Materials and my Exclusive GripTightTM Installation. After which, Clients choose ONE-OF-THREE "Good-Better-Best" FINISHING OPTIONS, in accordance with project requirements, available skill and budget, as follows:
1) DIY: Do-it-Yourself Finishing or,
2) Hire a local Tradesperson or Professional Floor Finisher or,
3) Ask me to Quote Marreed-Prestman's Proprietary Artistic Finishing, starting at $ 4.00 sf. featuring; all Premium Materials, Expert Sandings and my DoubleCoat, FloodCoat, Pour-Down Aluminum-Oxide Cured Finishing Technique.

C2: Any "Job Variable Adjustment/Rebate" or "N/C service" that may be offered is honoured by Marreed-Prestman

1) upon the successful completion of the job, 2): fulfillment of Marreed-Prestman's T&C, 3): provided full payment of Final Billing is made prior to Job Completion (as stipulated above)*.

1. Should any disagreement emerge over Final Billing, T&C statements will apply.

2. In the event of "non-payment" of Final Billing, "Job Variable Adjustment/Rebate" and "N/C services" that may have been included "pro bono" by Marreed-Prestman within the Final Billing are revoked ... full payment would then involve charges for "all work and services* that was actually provided (and digitally documented).

NOTE: Marreed-Prestman is always confronted with 'work required' and 'service options' that I fulfill (without customer notification) if my intent is to offer material/work/services at N/C or the material/work/service is 'too small an issue' to contact the customer for 'approval' or, where the product/work/service is an essential element in completing the job (without holding up the work schedule).

Note: Being of sound judgement, I have had only experienced one occasion where the client 'withheld' payment-on-demand for Final Billing but, eventually understood and made full and proper payment.

D: For worker safety, site security and job concentration, NO PERSON(S)* — including Principals, "inspectors", trades and delivery or service personnel, as well as, friends, neighbours or pets/animals — are permitted inside the Flooring Installation Construction Site/Working Area during workday hours for the period of time it takes to install your flooring or at any time — day or night — during 'critical' days in the Artistic Finishing Process:

*

1. The Exception: Should I be installing in an area not used as living quarters and not subject to "interruptions" (rec. rooms, etc.) and where we can segregate the work area from the living area and, where we can apply "non-toxic" waterborne topcoats, the above conditions may not apply.

Clients are asked not to invite friends and neighbours On-site (anytime, day or night) while the job is in progress.

 

D1: Marreed-Prestman does not "confer" with other trades or delivery/service personnel concerning your building project, nor do we supervise deliveries or "accept" or "sign" for deliveries or service confirmations made on-site (outdoors) "on your behalf" unless the action is requested by myself and directly associated with my immediate flooring job requirements.

D2: For safety* and security, telephone and power cords, air ducts, water, hydraulic and 'pump' hoses, or the like, can not be strung to/from/through or across any room or 'suspended' in any working or building access area:

*

1. The building must be "fully enclosed and lockable". For temperature and humidity control, windows, doors and "access ports" (floor and attic hatches, etc.) are not permitted to be "left open" at any time during the installation and finishing processes.

 

E: Additional items added or ordered by the Clients or deemed essential — at the sole discretion of Marreed-Prestman — to complete the job properly are subject to payment upon Final Billing wherever and whenever they may be applicable. E.g. Preparation Work; such as removing furniture from work areas, shim or level (slick mud) floor, ‘rebuild’ damaged subfloor, remove ‘glued’ carpet/underlay, secure a subfloor, add or change a custom floor design or number of finish coatings, build a "Crew Access" Ramp or protective Guard Rails for working crew, build a Trap Door or Stair Landing, build a Sub-Floor (strapping, sheathing) over concrete, bridge or taper floor to the level of adjoining rooms/buildings, cut passage/panel doors to fit height of new flooring, 'route' into or under log walls (in hand-scribed log buildings) to fit the floor into the logs around log guard rails, thread TV/telephone cables through sub-floor, install moulding around fireplace or staircase/balcony, cap and finish stairs steps (treads, risers, landings), grout fireplace base or tile (to fill, level or ‘match’), sand and paint door sills "to match", install soundproofing or insulation, refinish flooring in adjoining rooms, supply and install baseboards, window and door frames, build a decorative "room divider" and the like.

In most cases, additional items are known in advance and quoted with the job or ordered by the Clients but, some items 'discovered' and deemed essential to complete the job properly — at the sole discretion of Marreed-Prestman — during the construction process and are confirmed — whenever possible — in consultation with Clients:

*

1. Additional items such as, additional flooring, baseboards, etc., that are not ordered in the original contract but, added/ordered at a later date (perhaps, at the time of installation) will be charged in accordance with the current Price List in effect at the time the additional items are added/ordered. The ordering of more flooring for more rooms (or other large items) require payment, with order.

 

F: Restricted Access, Job Limitations and Special Requirements* are quoted, in most cases, in advance of the job. Clients agree to pay reasonable compensation to Marreed-Prestman for Restricted Access, Job Limitations and Special Requirements, as they exist or, as they may arise, while the job is in progress:
*

1. Restricted vehicle access to building door (delivery/working?), lack of on-site washroom or lack of sufficient electricity or electrical outlets, heat, "hot" running water, ventilation, (generators/heaters/fans?), indoor toilet?, utility basin?, lack of stair access to upper (loft) level floor?, high-rise (elevator access/height restrictions?), island (water access?), metropolitan area (excessive traffic congestion, restricted parking, parking charges?), bridge limits (multiple loads/trips? washouts?), ''unmassaged'', temporary or private roads (driving risk: washouts/snow?), tight stairway/doorway access (pre-cutting?), inhibited work space (wood storage/working/cutting?), inadequate or non-existent Preparatory Work—"G", etc.

 

G: The Clients acknowledge that the Preparatory Work* where not contracted to Marreed-Prestman — will be completed by the Clients or another contractor** prior to installation work (or "Finishing Only" ***) commencing, on schedule, as follows:

*

1. Remove all furniture, wall hangings, drapes, blinds, interior window screens in winter (only), ceiling light shades, etc. and empty all closets/shelves (where flooring is to be installed).

2. Remove baseboards, carpeting, underlay, tack rails, underlay staples (or remove the existing wood floor) then hammer down loose nails and secure (counter-sink screw) sub-floor. Remove passage doors, closet doors and floor tracks. Remove all wall hangings (decorative items and brackets). Scrape floor, vacuum and remove debris from the work areas and clear work buffer areas and access routes. Do not remove door frames or door mouldings.
3. Evaluate and secure work buffer areas and access routes ... making sure decks (posts and surface boards) and boardwalks can support the load of the material we move onto the job site and position 'in reserve' (on decks and walkways) as may be required.

4. Shut OFF Pilot Lights on gas appliances in working areas such as in a gas fireplace or kitchen stove. Do not shut off the Pilot Light for the main furnace. Refrain from firing-up any gas or wood fireplace, stove, lamp or heater. Ensure that flammable products (liquids and equipment) such as gas (ATV/boat/mower) containers, paint, solvents, etc., and gas-powered equipment are removed from the premises.
5
. Ensure hydro power availability with interior heat set at 20C (68F) with humidity control set to NORMAL 45-55% and air (fan or exhaust) ventilation set to "ON".

6. Insure that any "dry rot", "mould" or other "damage" and "contaminants" are properly addressed by a building specialist at least two weeks before the tentative installation date as such issues tend to be simple when done in advance or 'impossible' once installation begins and — if a health issue — will delay or cancel an installation job, at the sole discretion of Marreed-Prestman and at the expense of the Client.

**

1. Clients involved with new construction are to ensure that furniture or fixtures, including baseboards, stairs/rails/balusters, "floor fixtures" construction materials/equipment, etc., do not interfere with normal Tongue & Groove wood floor installation. (If in doubt, talk with me or have your builder contact me.)
Baseboard Heaters are raised by my crew in order to install the floor but, "connecting wires" must be extendable at least six (6") inches.

2. Preparatory work not completed to my "standard preparation" may need to be "improved" at additional expense. (25% of order, minimum as follows (whichever is greater): $ 250.)

3. Electrical panels utilizing fuses (and not breaker switches) are to be 'well stocked' with appropriately-sized fuses.

 

Final Finishing Only

The Clients acknowledge that Preparatory and Installation Work — where not contracted to Marreed-Prestman — will be completed by the Clients or another contractor prior to Marreed-Prestman commences with "Finishing Only" on schedule, as follows:

1. Clients are responsible for the quality of materials, installation methods and the effects of by-products (such as nails, glue, etc.) that may or may not effect the quality and processes of Final Finishing ... "Final Finishing" (only) jobs are guaranteed against DEFECTS related to Marreed-Prestman's portion of the work only: fully excluding — but not limited to — "any effect" of any substandard subfloor, client/contractor supplied preparatory work, materials, installation and clean-up. Avoid Solvents, Glues, Tapings, Ladders, Heavy Toolboxes, etc. on an unprotected floor. As with any wood floor, lay paper, plastic or plywood, as required to protect the floor while doing after work. Expect that 'professional' trades people — electricians, plumbers, painters, appliance delivery personnel and the like, will not think to take logical and necessary precautions, unless supervised.

 

H: Marreed-Prestman may deliver materials to your site in advance of installation and record digital photographs of materials on site ... it is the Client's responsibility to secure the site against theft, fire, etc. Specifically, the Clients assumes full responsible for securing delivered materials and for loss or damage* of delivered materials however caused, without exception.

*

1. Materials will be placed in your site in a strategic manner for reasons of load safety and acclimatization and to protect the T&G wood profile. Therefore, flooring materials are not to be moved or handled nor, is the heating/ventilation thermostats or monitors to be 'reset' without 'approval'.

 

I: Marreed-Prestman expects to start and complete your job on schedule in accordance with my Tentatively Scheduled Commencement and Tentatively Scheduled Completion Dates*, but, I will not rush the job or reduce the quality of work — or jeopardize my expectation of the job result — for any reason ... your responsibilities, expectations and daily schedules should allow leeway — without claim or compensation — for delays due to preparation time, work flow, finishing and curing times, indoor/subfloor humidity, adverse weather conditions (electrical storms/snow storms), and the like.

 

Lost Time

*
1. Marreed-Prestman will not be held responsible or be expect to make up for "LOST TIME" because of delays you may have experienced with prior trades or suppliers. However, "Rush Service" in the form of additional crew and improved on-site services may be available at additional cost, upon request.

2. Marreed-Prestman reserves the right to change the "Commencement Date" and "Completion Date" for your project, due to "health or emergency", "severe or dangerous weather conditions" or the like; Marreed-Prestman will give prompt verbal notice and written (e-mailed) confirmation, without compensation.

3. Marreed-Prestman reserves the right to change the "Commencement Date and/or Completion Date" for your project should an existing job — a job-in-progress — exceed its expected Completion Date beyond what is considered 'normal' and anticipated and allowed for in a reasonable "buffer period" between jobs ... an in-progress and extended job could interfere with preparation time that is planned for your job and it could limit crew availability, without claim or compensation.

 

If you are unable to accept the installation and finishing of your floor in your chosen time-frame because of a delay in the building/renovation process, unsafe access or, because the floor is not clean and free of debris/construction material or otherwise, not "properly prepared" (by Clients) or, for lack of electrical power/outlets, heat, ventilation, "hot" running water or, overlapping trade "interference", or perhaps, an unacceptable hindrance, such as 'excessive' dust, noise, vibration or humidity levels (drywall sanding, water well drilling, "impassable" and 'unassumed' roads or snow-blocked driveway, etc.) — then, Marreed-Prestman reserves the right to decline starting or continuing on your job due to unacceptable working/installation conditions and normal safety concerns. In such a case, we will work with you to reschedule your installation/finishing time-frame to my next available date which may be a day, week, month or longer. In addition, Marreed-Prestman reserves the right to "split" a delayed and rescheduled job to fit into my work schedule. A "Job-Split" Fee may apply (Minimum $ 500.).

 

J: Marreed-Prestman may accept your Labour Crew and provide a Labour Cost Rebate... you and/or two or three of your STRONG "Family or Friends" can act as "CREW" on your job only. I hold myself fully responsibility for the high quality of your flooring project. "Crew" is usually required for about two or three days in total.

10b) Likewise, Clients who choose to provide reliable local and experienced construction labour (one, two or three strong men with basic but, reliable, tool-handling ability to work under my direct hands-on supervision (for about two or three days in total.), are responsible for the availability and basic performance of the crew they hire. In exchange, Marreed-Prestman will credit clients "who choose to hire locally" the equivalent of $ .75 sf. Furthermore, Clients accept that Marreed-Prestman regularly and easily installs 400 sf. to 500 sf. on "Start Day" and 600 sf. to 800 sf. on subsequent days. Therefore, client-supplied workers are expected to attain this basic standard of performance in order to control installation costs and meet our desired timeline.

K: Marreed-Prestman uses power tools and other normal installation and finishing equipment* ... solvents, cleaning and finishing products, dehumidifiers, fans and heaters as required. Although, we take "every precaution"...

1. Clients accept responsibility and liability for any electrical "malfunctions", fire, etc., however caused, without exception,
2. Clients accept responsibility and liability for ‘unauthorized’ persons (i.e. neighbours, family, visitors, pets) on-site,

3. Clients authorize Marreed-Prestman to shut-off or disconnect — at its discretion — any audible fire, carbon-monoxide or security alarm system while we occupy the building,
4. Clients authorize Marreed-Prestman to deny or disconnect — at its discretion — any "interruptive source" of my power supply, which may include power being drawn from the building to accommodate other trades working on the exterior of the building or on the property. (Those trades must use their own independent generator as 'power fluctuations' due to heavy power consumption (by some trades) will affect my specialty sanders and hinder their required operating speeds).

5. Clients authorize Marreed-Prestman to provide an electrical generator (at additional cost, plus travel) should the power sources available prove insufficient or 'unsafe' to power-up "initial surge" equipment.

6. Clients should expect utility costs (hydro, heat) to 'spike' due to installation power/energy consumption ... an average of approximately $50. per 1,000 sf./installation).

 

L: Should it not be in the interest of either or both parties to continue "working together" on your project due to one or more major infractions of the T&C (by the client) ...

1. Marreed-Prestman is entitled to "full, proper and immediate payment for the full Contract Price" and additional products/labour/services and billable items listed in the Final Billing.
2. Marreed-Prestman will upon your written request and my acceptance, "be of service in an advisory capacity only" at no additional cost (except for travel) for a period of up to 15 days of any "cancellation" or "suspension" of the flooring contract (time permitting and at the discretion of Marreed-Prestman).

 

M: On average, all Client Access* to the job site is restricted (for a minimum period of 4 to 6 days) during the critical Artistic Finishing Process.

1)  The job site is restricted to other trades and can not be 'occupied' by people or pets for the time period required to install and finish your flooring although, we try to facilitate "after-hours" on-site living and Client Access based on reasonable expectations during the installation process.
2. "Curing Time" is three (3) full days after the final finishing, under ideal conditions, prior to Client Access (in dry stocking feet or soft-sole shoes

3.  Move in furniture on Day #4 after the final finishing.

4. "Full Cure Time" is ten (10) days, in ideal conditions, prior to the introduction of any dog, area carpets, floor plants/trees, etc.

N: A Marreed-Prestman Red Pine floor will still ding, dent and scratch but, my method of distressing and SFX finishing camouflages abuse ... the eye is not drawn to any particular mark (new or old). my 'animal-friendly' Diamond-Tough Flood-Coat Finish is critically important. It's magic because it's Livable when you live with kids and dogs (or they visit).

 

O: Force Majeure

A. Marreed & D. Prestman 'Distressed' Red Pine Flooring Inc. failure to perform in accordance with the Terms or Conditions of this Agreement as a result of conditions beyond my control such as, but not limited to, war, strike, flood, governmental restriction, power failure, or damage or destruction of transportation or building facility or equipment or supply or supporting service, shall not be deemed a breach of this Agreement.

 

P: Goodwill Guarantee

A. Marreed & D. Prestman 'Distressed' Red Pine Flooring Inc. guarantees each and every new floor that we install* against any DEFECT in supplied materials and workmanship for as long as you own your floor* (non-transferable) provided contract T&C are fulfilled.

Red Pine flooring is a natural  product ... it is not a composite, it is not plastic, as such, ~ 1% expansion and contraction of the wood in the annual "breathing" process is normal. Additional, expansion and contraction may be "aggravated" by the "lack of normal temperature and humidity levels" in the building prior to, during or after the installation and finishing processes.

1. Clients will allow for standard Curing Times which will include a timeline for the introduction" of furniture and animals in accordance with T&C.

2. Owners Risk: Goodwill Guarantee does not extend to any 'complication' that may arise due to the installation of a solid wood floor over any in-floor heating system, nor over subfloor piping, wiring, etc. Nor "over and above" any wood-burning stove/fireplace, garage, etc., Nor in any 'substandard' structure whereby heat, humidity and stability may be compromised. Subject to Third Party Professional Assessment at Owners expense.

 

Q: A. Marreed & D. Prestman 'Distressed' Red Pine Flooring Inc. does not accept liability, financial or otherwise, beyond the above-stated Goodwill Guarantee.
